The report cites a HHS memo looking for clarity on a gender definition under Title IX, the federal civil rights law banning gender discrimination in education programs that received federal funds.

According to The New York Times, the leaked proposal - that was released by the Department of Health and Human Services - begins: "Sex means a person's status as male or female based on immutable biological traits identifiable by or before birth". If enacted, it also would do away with a series of moves by the Obama administration to recognize a person's gender as an individual's choice and not determined by their sex assigned at birth.

LGBTQ leaders across the USA reacted with fury Monday to a report that the Trump administration is considering adoption of a new definition of gender that would effectively deny federal recognition and civil rights protections to transgender Americans.

About 1.4 million Americans identify as transgender.

Perhaps most worryingly, the report also goes on to claim that the department urges the administration to determine a more rigorous and uniform definition of gender "grounded in science" and that a person's sex, once identified, be unchangeable.

"Transgender people are frightened", said Sarah Warbelow, legal director of the Human Rights Campaign, which presses for the rights of lesbian, gay, bisexual and transgender people.

The Justice Department has not yet been asked to render a formal legal opinion, according to an official there who was not authorised to speak about the process.

A spokeswoman for the Department of Health and Human Services (HHS) declined to comment on what she called "allegedly leaked documents" but cited a ruling by a conservative United States district judge as a guide to transgender policy.

A 2016 ruling by O'Connor concerned a rule that was adopted to carry out a civil rights statute embedded in the Affordable Care Act.

That's not very controversial, particularly for HHS subsidiaries, who have struggled to handle questions about gender-based discrimination that arise, specifically, under Title IX, which covers sex and gender issues at publicly funded colleges and universities. The objective of the redefinition is to deny transgender people protection under federal civil rights law that prohibits discrimination on the basis of sex.

But the paper points outs that other court decisions have gone in favor of the Obama administration's position.

"A federal court has blocked HHS's rule on gender identity and termination of pregnancy as contrary to law and infringing the rights of healthcare providers across the country", Severino's statement said.
