Dancing FBI agent offered plea deal in club shooting

The lawyer said that Federal Bureau of Investigation agents are urged to carry their guns with them even when they are not on duty.

Almost two weeks after the incident, the Denver District Attorney's office announced that Bishop was charged with second-degree assault, a felony, after turning himself in. Trying to be slick about it, the off-duty Federal Bureau of Investigation agent tried to pick up his gun, which discharged and wounded 24-year Thomas Reddington in his leg. Bishop is shown dancing by himself in the middle of a group of people at the bar.

Denver County Court Judge Fran Simonet granted Bishop's request to modify a protection order against him to allow him to carry his service weapon in accordance with Federal Bureau of Investigation rules requiring agents to be armed while on- and off-duty. Prosecutors didn't object to the modification.

The FBI has not commented on the case, other to say it is cooperating with the Denver Police Department.

The agency has also not released any information concerning its policy for agents while off-duty in bars.

Prosecutors previously said Bishop could face additional charges pending toxicology tests, but a spokesman for the Denver District Attorney Office told ABC affiliate station KMGH-TV that the test results did not support further charges.
