Bethesda Claims Westworld Mobile Game is a Blatant Rip-Off

And if Bethesda can prove it, that's pretty damning evidence that Behaviour did in fact build Westworld using Fallout Shelter source code.

Bethesda filed a federal lawsuit in Maryland (where Bethesda is based) against Warner Bros.

The Westworld game resembles Fallout Shelter, a management sim released three years ago for smartphones and later on PS4, Xbox One, PC, and most recently the Nintendo Switch. Bethesda believes that Warner Bros. coveted their success and induced Behaviour to divulge Bethesda's trade secrets. All in all, Bethesda is alleging that the game is nearly a direct copy of Fallout Shelter's assets with simple cosmetic changes to fit the new theme. Bethesda also brings this action against Warner Bros.

Warner Bros. and Behaviour Interactive did not immediately respond.

But wait. There's more: Fallout Shelter itself isn't really unique. Bethesda conceived of and designed the environment and gameplay features for FALLOUT SHELTER to fit within the aesthetic and storyline of the FALLOUT universe. But the free-to-play title apparently goes too far with that apparent inspiration, as developer Behaviour Interactive has been accused of reusing code that it developed for Shelter.

Bethesda also argued that there are visual similarities between Fallout Shelter and Westworld, and it pointed to a March 2018 post from Kotaku to support its case.

In October 2016, Warner Bros. began broadcasting the television show Westworld on its HBO platform. "Fallout Shelter, ' released in 2015, tasks players with building and managing an underground bunker, keeping the facility in operation by tending to the needs of its occupants, and by sending vault dwellers out to the rest of the world". "As a result of Behaviour and Warner Bros" unlawful conduct, "Westworld" is a blatant ripoff of 'Fallout Shelter" with largely superficial, cosmetic changes. It alleges that Westworld; "has the same or highly similar game design, art style, animations, features and other gameplay elements". Behaviour provided the implementation and according to Bethesda, all work and materials created by Behaviour for the game are the property of Bethesda. In the complaint, the company outlines one such bug involving an out-of-focus camera shot when starting the demo version of Westworld. The identical problem appeared in initial versions of FALLOUT SHELTER but was addressed before FALLOUT SHELTER was released to the public.
