Notley to skip premiers conference so she can focus on pipeline deal

Alberta Premier Rachel Notley left and Prime Minister Justin Trudeau

Eby said the lawsuit filed Tuesday in Alberta's Court of Queen's Bench challenges the constitutionality of Alberta's law because it is meant to punish B.C.

The Canadian senate has passed a bill calling on the federal government to put its weight behind the successful completion of the Trans Mountain Pipeline expansion project.

The lawsuit claims the legislation is unconstitutional because it violates section 121, which allows: "All articles of the Growth, Produce, or Manufacture of any one of the Provinces shall, from and after the Union, be admitted free into each of the other Provinces".

Notley said her deputy premier would stand in for her at the regional leaders conference in Yellowknife.

Premier Notley initially praised the Horgan move as a step in the right direction ("stepping back from the brink and abiding by the law") and suspended her wine boycott.

"Albertans, British Columbians and all Canadians should understand that if the path forward for the pipeline through B.C.is not settled soon, I am ready and prepared to turn off the taps".

"In representing Alberta at the table, we want to make something very clear", she said.

On Tuesday, she complained that B.C.is seeking the power to limit oil exports while insisting Alberta must sell B.C. its fossil fuels on demand.

"A significant percentage of the gasoline and diesel consumed in British Columbia is imported from Alberta refineries, either by pipeline, train or tanker truck", the B.C. statement of claim concedes. But in the lawsuit filed on Tuesday, B.C. argues Alberta can not punish it for that stand by cutting off domestic fuel supplies.

It's a powerful argument, relying as it does on the words of Alberta politicians themselves about their intentions in crafting Bill 12.

The B.C. government has filed a reference case in the provincial Court of Appeal to determine if it has jurisdiction to regulate heavy oil shipments.

Kinder Morgan has ceased all non-essential spending on the $7.4-billion pipeline project that would twin the existing pipeline between Burnaby, B.C., and Edmonton.

Moe has said the federal government should withhold sending federal infrastructure money to B.C. over that province's opposition to Trans Mountain. "We will use every tool in our tool box to stop the project from going ahead". "For Alberta, all other issues had to be subservient to that", he said.
