Gov. Eric Greitens's Charge Is Dropped, for Now, in Missouri

Missouri's Republican legislative leaders renewed calls for Greitens to resign and confirmed they still will convene Friday in a monthlong special session to consider whether to impeach Greitens to remove him from office. A trial date has not been set in that case. Greitens has admitted to the affair, but denied taking the photo.

"I think anything that this circuit attorney's office has touched or its investigators [have touched] should be dropped because it's tainted, it's biased and those decisions can not be looked at as objective", Scott Rosenblum, a member of Greitens' legal team, said. "This is a great victory and it has been a long time coming", Greitens told reporters outside the St. Louis circuit courthouse. He apologized to his family and the people of Missouri, saying that the "humbling" experience had taught him "wisdom".

Judge Rex Burlison of the 22nd Circuit granted a request by Governor Greitens' defense team to call Circuit Attorney Kim Gardner as a witness in the case, accusing her of misconduct and prompting her to abandon the case on Monday. The lawyers for Mr. Greitens had accused Ms. Gardner of condoning misconduct and lying by an investigator on the case, and apparently meant to question her on those issues.

"The law does not require a jury of 12 ignoramuses; it doesn't require a jury of 12 people who have lived in a cave", said University of Missouri law professor Frank O. Bowman III.

"A defendant who wishes to call a prosecutor as a witness must demonstrate a compelling and legitimate reason to do so", Gardner spokeswoman Susan Ryan said Monday.

Gardner's office said she may refile the criminal invasion of privacy case charges against Greitens and appoint a special prosecutor or one of her assistants to the case.

"When the court and the defense team put the state in the impossible position of choosing between her professional obligations and the pursuit of justice, the Circuit Attorney will always choose the pursuit of justice", Gardner's office wrote in a statement.

Eric Greitens, an attorney representing his campaign operation has not fully complied with subpoenas issued by the Missouri House, the chairman of the panel said Monday. It is not known whether the phone examined is the same one Greitens was using during the time the photo allegedly was taken.

His attorneys, however, were much more outspoken, both in their criticism of Gardner's conduct during the case and their assertion that the case should not be refiled. An investigator that Gardner hired, William Tisaby, allegedly made false statements during a deposition about his interview with the woman at the center of this case.

On February 22, 2018, a Grand Jury indicted Governor Greitens on Felony Invasion of Privacy.

Prosecutors said that Greitens took a nude photo of his lover without her consent in 2015, then threatened release the image if she didn't keep quiet about the affair.

She also alleged that Greitens forced her to the ground and coerced her into having oral sex, according to the committee's report released last month. Greitens didn't testify to the committee.

"We continue to go through the burdensome process of gathering and organizing thousands of additional documents for review by the committee, and of course, my clients will assert the same rights any party would have to object to requests that aren't relevant to the committee's investigation", Hanaway added.
