Gotta Have Rock and Roll told the Daily News that the Madonna items would go back on auction in July this year.

You might recall how back in July of a year ago, it was announced that a letter written by Tupac Shakur to Madonna was set to head for auction, with bidding starting at $100,000.

Tupac's personal belongings also included a break-up letter that Tupac Shakur had written for Madonna and a hairbrush with strands of her hair.

Madonna won't be able to put the brakes on the sale of an old jailhouse letter from Tupac that's being auctioned off because of a release she signed nearly 15 years ago.

Madonna failed to stop her longtime friend and auctioneer Darlene Lutz to stop the sale, which was stopped temporarily pending the outcome of the matter.

Lutz and Madonna's longtime friendship deteriorated after they brokered the settlement. In a statement, the organisation said it had been confident about the case and undertaken "substantial due diligence" before announcing the initial auction. She won a temporary stay blocking the auction last summer.

In 2004, Madonna had also signed a release from "any and all" future claims against Lutz, meaning she could not bring this lawsuit.

Madonna has yet to comment on the court decision, but Lutz's attorney, Judd Grossman, is celebrating what he's called a "complete win" for his client.

Madonna had claimed in her lawsuit that she did not know Lutz was in possession of the personal letter until she heard about the auction previous year.
