Cohen, Trump Push To Decide What's Protected By Attorney-Client Privilege

Not Released

Lawyers for Cohen and prosecutors both had reason to claim success after three hours of arguments before U.S. District Judge Kimba Wood, who said she may appoint a special master, a neutral lawyer, to help decide which materials should stay confidential.

On Sunday, attorneys with the law firm Spears & Imes filed a letter on Trump's behalf, arguing that Trump is asserting his attorney-client privilege, and should be allowed to view the documents so that he and his legal team can determine which ones are privileged before the government's team makes that decision.

Daniels' lawyer Michael Avenatti also appeared Friday and suggested that some of the seized materials may involve the adult actress.

Wood said she would consider the idea.

Cohen did not respond to a request for comment.

Monday's raids included a search for communications related to efforts to suppress negative information ahead of the election, including communications that Trump had with Cohen regarding the infamous "Access Hollywood" tape that captured Trump making lewd remarks about women that surfaced a month before the election, CNN reported this week.

Cohen is under scrutiny for payments he made to Karen McDougal, a former Playmate, and Stephanie Clifford, who performs under the name Stormy Daniels.

In his regular broadcast Monday, Hannity says he had "brief discussions" with Michael Cohen about "legal questions where I wanted his input and perspective". Daniels, who has been talking openly about what she says was her liaison with Trump, is suing to get out of the agreement.

Cohen's lawyers were required by a federal judge in NY to disclose the names of his clients Monday as part of an argument over attorney-client privilege and how it applies to records seized from Cohen last week by the FBI.

That is despite the Justice Department's creation of an independent team - a "clean team" or a "filter team" separate from the prosecutors and investigators looking into Cohen - to review the material.

Trump's request, in the form of a letter from other lawyers representing him, could further complicate a hearing set for Monday afternoon.

Stormy Daniels's attorney asked to join in on the hearing, as he said he believes items seized were in regards to his client.

"I have many (too many!) lawyers and they are probably wondering when their offices, and even homes, are going to be raided with everything, including their phones and computers, taken".

Michael Cohen's legal career continued its plunge toward the bottom of Disbarment Sea this weekend, as reports that he is the subject of a federal criminal probe were quickly eclipsed by the revelation that in Republican circles, Cohen has quietly earned a reputation as New York's preeminent practitioner of "Find creative ways to ensure that your chronic philandering never interferes with your family's political aspirations" law.

In a court filing Monday morning, Cohen's lawyers argued that Cohen should not be required to turn over the names.

The Justice Department wants a group of its own attorneys known as a "taint team" - those not working on the criminal case against Cohen - to examine the records. Mueller's office referred the case about his business dealings to NY but hasn't been involved since, the Manhattan prosecutors said. He has denied wrongdoing.
