Judge Loya death case SC to hear pleas seeking independent probe into'mysterious death

The Congress president's decision to speak to the media came after the senior judges had held a press conference to claim that Chief Justice of India Dipak Misra was being selective in allocating cases to the SC benches and said the Loya case was one such that had been flagged with the CJI.

The Supreme Court on Friday termed the alleged mysterious death of CBI judge B.H. Loya, who was hearing the Sohrabuddin Sheikh encounter case, as a "serious matter" and asked the Maharashtra government to respond by January 15.

The plea was filed by Maharashtra-based journalist B R Lone.

Before the commencement of hearing senior counsel Dushyant Dave, representing Bombay Lawyers' Association said the high court was already seized of the matter and the top court should refrain from hearing the issue.

Judge Loya had died on December 1, 2014, in Nagpur, where he had gone to attend the wedding of a colleague's daughter.

The publication cites various alleged manipulations in records on the night of Loya's death.

The case with major political overtones pertains to the killing of suspected gangster Sohrabuddin Sheikh and his wife Kausar Bi and their associate Tulsidas Prajapati in Gujarat in November 2005.

On Friday, Bombay High Court too is expected to hear a public interest plea seeking a probe into Loya's death, moved by the Bombay Lawyers' Association.

The case was later transferred to CBI and the trial was shifted to Mumbai.

"Unprecedented points raised by the honourable judges need to be looked into carefully, even Justice Loya's case must be looked at by the highest levels of the Supreme Court", Gandhi said at a press conference in New Delhi.

Advocate Varinder Kumar Sharma, appearing for another petitioner, Congress leader Tehseen Poonawala, said this is a case where a mysterious death of a judge has taken place on December 1, 2014, and it needs to be investigated. I have nothing to do with the politics surrounding the case.
