Grandparents who claimed pot was meant for Christmas gifts arrested again

An elderly couple arrested last month after police said they claimed they had more than 60 pounds of marijuana in their auto to give out as Christmas gifts is facing new charges after being arrested Tuesday morning in Nebraska, according to multiple reports.

They were arrested last month in the same vehicle, just two counties west.

A drug dog indicated it smelled drugs in the truck so deputies searched the truck and found most of the money in a duffel bag in the truck's cargo area, the report said.

Sergeant Mayo said the vehicle was traveling westbound from Vermont to the Jiron's home state of California.

About $18,000 in cash, allegedly tainted by pot, was found in their vehicle, a 2016 Toyota pickup. The York County Sheriff's Office said the estimated value of the marijuana was $336,000.

Wagner said Patrick, 83, and Barbara Jiron, 80, were taken to jail on charges of possession of money while violating the state's narcotics statutes.

The deputy asked the couple if he could search the truck, but he was denied.

The couple were free pending the outcome of the original charges, and Barbara Jiron was supposed to appear in court Wednesday afternoon to be arraigned on her first arrest.

The couple have a family connection in Vermont law enforcement, according to the Associated Press; their son, Justin Jiron, is a Chittenden County criminal prosecutor.

Patrick Jiron was placed in York County Jail, while Barbara's processing was delayed due to a medical issue, Fox News reported. En route to Vermont, the Jirons told police they were unaware it was illegal to transport marijuana through Nebraska and they were planning to give the drug as Christmas presents.

In York County, both were charged with possession of marijuana with the intent to deliver, a Class 2A felony, and having no drug tax stamp, a Class 4 felony.

The couple are scheduled to appear in York County Court on January 17. The wire service reports, "State's Attorney Sarah George has said Justin Jiron is not connected to his parents' alleged crime other than by relation".
