A Judge Revoked a Man's Status as a Naturalized Citizen

Baljinder Singh, 43, from Carteret, New Jersey is the first naturalized Indian American citizen to be stripped of his USA citizenship under the Trump administration.

"The defendant exploited our immigration system and unlawfully secured the ultimate immigration benefit of naturalization, which undermines both the nation's security and our lawful immigration system", said Acting Assistant Attorney General Chad Readler of the Justice Department's Civil Division. "The Justice Department will continue to use every tool to protect the integrity of our nations immigration system, including the use of civil denaturalization".

The government filed the complaint against Singh last September, along with two other cases against Pakistan-born naturalized citizens in CT and Florida.

Singh, whose immigration status was ordered back to permanent resident, could face removal proceedings at the discretion of the Department of Homeland Security, the Department of Justice said in a statement Tuesday.

In an announcement on January 9, the Department of Justice said in a memo that Baljinder Singh, also known as Davinder Singh, is no longer a naturalized US citizen after the government learned that he may not have gained citizenship lawfully. Among those cases, some may have sought to circumvent criminal record and other background checks in the naturalization process. Operation Janus was launched in 2010.

The Justice Department announced that Judge Stanley R. Chesler of the US District Court for the District of New Jersey entered an order revoking the naturalized US citizenship and canceling the Certificate of Naturalization of Baljinder Singh.

Two similar complaints filed against two men from Pakistan living in CT and Florida are pending.

The Department of Justice, which moved a petition in this regard before a U.S. court last September, said that Singh in his citizenship application concealed prior orders of exclusion and his deportation under different identities than the identity under which they naturalised. He did not appear for court hearings and was ordered to be deported in January 1992.

But Singh, who the Justice Department said later abandoned the asylum application, allegedly failed to disclose that he had entered the U.S.in September 1991 under the name Davinder Singh, court documents said. In 1996, according to the complaint, his application for permanent residency was approved.

In support of its complaint against Singh, the Justice Department submitted a lab report from USCIS comparing a January 24, 1992, fingerprint card under the name "Baljinder Singh" to a September 25, 1991, card with the name "Davinder Singh", court documents said.

A similar case to that of Singh emerged previous year when two Pakistani individuals were revoked of their citizenship by the Department of Justice.
