A man is suing Sunwing Airlines for not serving champagne

When Daniel MacDuff boarded a Sunwing flight to Cuba in February 2017, he expected champagne service, as advertised.

Mr Macduff's lawyer says the class action hinges on misleading marketing and not the quality of the wine served.

Legally, a bottle of sparkling wine can only be labelled "champagne", if it has been made in the Champagne region of France and produced using the "méthode champenoise".

The resident of L'Ancienne-Lorette, a suburb of Quebec City, claims he could have chosen one of two other airlines on his trip to the resort of Cayo Coco.

Montreal lawyer Sébastien Paquette said: "It's not about the pettiness of champagne versus sparkling wine". "That attracted his attention, given that the price point seemed to be the same for all three options".

The airline is no longer referencing "champagne service" in active marketing campaigns but is still offering sparkling wine to all passengers on flights to southern vacation destinations.

Paquette said the suit is less about the differing cost of the beverages and more about the need to fight Sunwing's advertising practices.

Sunwing responded saying the lawsuit was "frivolous and without merit".

"Sunwing has always been proud to invest in experience-enhancing features for our customers", it says in a statement.

He said it's too early to put a dollar figure on the amount.

The suit would be filed on behalf of any Quebec resident who bought a Sunwing package that included the word "champagne" in its marketing since February 2014.
